In today's digital age, while information flows with unparalleled ease, distinguishing truth from deception has become a formidable challenge.1 The vast expanse of the internet, particularly social media, is rife with misinformation.2 As societies confront these consequences, lawmakers globally are racing to sculpt balanced legal frameworks aimed at preventing the spread of fake news and its manipulation of public sentiments.3

A Look Back: Misinformation in the Analog Age

The challenges posed by misinformation are not a strictly modern phenomenon.4 For as long as media has existed, so too have attempts to twist and manipulate information. However, the mechanisms to regulate and control misinformation were markedly different in the age of traditional media.5

Historically, newspapers, radio, and television were the primary gatekeepers of information.6 These entities were often regulated by governmental bodies or independent councils that established codes of ethics and standards of practice.7 For instance, in the United States, the Federal Communications Commission (FCC) was responsible for overseeing and regulating interstate communications by radio, television, wire, satellite, and cable.8 One of its notable policies was the Fairness Doctrine, introduced in 1949. Singapore's Protection from Online Falsehoods and Manipulation Act (POFMA)

Singapore, known for its strict regulations in various spheres, adopted a more direct approach with the introduction of POFMA.59 This act gives the government sweeping powers to act against online falsehoods that are deemed to be against the public interest.60

Key features of POFMA include:

  • Direct Action: The government can order corrections, removals, or block access to content deemed to be false.61
  • Penalties: Individuals or entities found guilty of spreading falsehoods with malicious intent can face hefty fines or even imprisonment.62
  • Speed: Recognizing the rapid dissemination of information online, POFMA allows for swift action, with platforms sometimes having mere hours to comply with government directives.63
